The Rajasthan High Court has said in a decision that in the cases to corruption, the anti -corruption bureau in its jurisdiction of the state can not only register a case against the Central Government employees, but can also present the challan after investigating the case. There is no provision that the ACB cannot register a case against the Central Government employees or a person under the Central Government under its jurisdiction. Along with this, the court, while removing the ban on the action of ACB in favor of the applicants in the case, sent the case to the regular bench for hearing. Justice Sudesh Bansal gave this order while fixing the criminal petitions of Mukesh Singh and others.
The court said that in corruption cases against central government employees, the CBI has not been given special rights to ban the ACB under the Prevention of Corruption Act or DSPE to register these cases, investigate and present challans. In fact, in these criminal petitions, the Central Government employees challenged the ACB action in the High Court. The High Court had earlier heard the case and stayed the ACB action against him. During this time, the court came to decide the point that under the Prevention of Corruption Act, the Central Government Employees or a person under the Central Government, if any crime committed under the jurisdiction of Rajasthan State, can ACB be able to register such a case, investigate, investigate and present a challan in the court. Apart from this, whether only the CBI has the right to investigate the corruption cases against the central government employees and can the ACB case not proceed to the ACB case without the approval of the CBI.
