Jabalpur, October 11 (Read News). The single bench of Justice Vishal Mishra of Madhya Pradesh High Court has put a stay on the hearing of the land dispute case being conducted by Additional Commissioner Sagar by sending a notice to the opposing party on WhatsApp. After preliminary hearing on the matter, this interim order was passed while issuing notice to the non-applicants.
Actually, Dinesh Kumar Dubey, resident of Khurai in Sagar district of Madhya Pradesh, has filed a petition in the court of Additional Divisional Commissioner of Sagar for an appeal to property dispute. In which it is said that some of the opposing parties of the case, who are residents of Uttar Pradesh, are being heard by the Additional Commissioner by sending them notices on WhatsApp. Advocate DK Tripathi, on behalf of the petitioner, told the court that merely sending a message on WhatsApp cannot be considered as service of notice. It is unfair to conduct the final hearing on the case without considering whether the concerned party saw the message or not. On this, the High Court has given instructions to issue a notice staying the hearing of the appeal. Information about the above instructions being given on Friday has come to light.
