The bench of Justice Neena Bansal Krishna clearly said that the case is completely quashed. Gambhir, along with his wife Natasha Gambhir, mother Seema Gambhir and Gautam Gambhir Foundation, had challenged this case. The case dates back to 2021 when the Drug Control Department of the Delhi government had alleged that former MP Gautam Gambhir and his foundation collected Covid medicines like Fabiflu without a valid license and distributed it among the needy. For this, a case was registered under Section 18(c) and 27(b)(ii) of the Drugs and Cosmetics Act, in which there is a provision of punishment of minimum three years and maximum five years for selling or distributing medicines without license. After Kot's decision, Gambhir also shared a post on social media and wrote, 'I have always had full faith in the justice system! Thank you Jai Anand Dehadrai.

Case canceled after 4 years

The trial court had issued summons to everyone including Gambhir, his wife, mother and Foundation CEO Aparajita Singh. A petition was filed against this in the High Court. In September 2021, the High Court had stayed the trial court proceedings. However, the court had lifted the stay in April 2025, after which Gambhir had applied again and demanded reinstatement of the stay and cancellation of the case.

Counsel for the Drug Control Department opposed this and said that the petitioners have admitted that the medicines were distributed, even if not sold. His argument was that distribution without license is also a crime. But after hearing all the arguments, the High Court dismissed the entire criminal case. This decision of the court has brought great relief to Gautam Gambhir and his family. This work, which started with the intention of helping the needy during the difficult times of the pandemic, got stuck in legal entanglements. Now the court's decision has put an end to this controversy.
